Seminar “Efficiency in Economic Damages Cases”

On 8 September 2025, E.CA Economics had the pleasure of hosting the seminar “Efficiency in Economic Damages Cases” as part of the Berlin Dispute Resolution Days.
The session was opened by our director Elżbieta Głowicka and presented by our directors Thomas Hildebrand and Anselm Mattes, who highlighted the role of economists in arbitration proceedings and addressed the challenges of establishing the ‘economic truth’ in damages claims.
A recurring difficulty in such cases lies in the divergence between expert reports – not only in terms of data and methodology, but most importantly in the outcomes. Such discrepancies can significantly increase the complexity, cost, and duration of proceedings. Our contribution underscored how a well-structured process can help reduce these divergences, thereby improving efficiency and lowering costs.
The Berlin Dispute Resolution Days gather arbitration specialists, practitioners, in-house counsel, academics, judges, policymakers, and other stakeholders. Through lectures, panel debates, and exchanges of perspectives, the event provides valuable impulses for the future of dispute resolution and fosters an excellent environment for professional networking.
